QUESTION:

What do the scholars and muftis of the mighty Shari’ah say regarding the following matter: if one missed the jama’at (congregation prayer) of Isha, is he allowed to join the jama’at of Witr?

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

If one performed Isha salaah alone meaning he did not perform it with the jama’at, then he should perform Witr prayer alone. As mentioned in Radd ul Muhtar:

لَكِنَّهُ إِذَا لَمْ يُصَلِّ الْفَرْضَ مَعَهُ لاَ يَتْبَعُهُ فِي الْوِتْرِ

“However, if he did not perform Isha salaah with the Imam, he should not follow him in Witr.”

 [Radd al-Muhtār, Book of Prayer Vol. 2, Pg. 48]

Also it is stated in Bahaar e Shari’at:

“And if he performed Isha alone then even if he performed Taraweeh with jama’at, he should perform Witr alone.”

[Bahare  Shariat Vol. 1, Part 4, p. 693]

However, in this situation if he prayed Witr with jama’at then his prayer is valid.
