QUESTION:

What do the scholars of the Din and muftis of the Sacred Law state regarding the following issue: can a woman refer herself to a gynaecologist whilst she is fasting? This a doctor who uses internal ultrasound to examine matters related to the birth of the child. Internal ultrasound requires the doctor to insert medical tools into the private part of a woman; this does not invalidate the fast.

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

If the doctor does not apply medicine or any liquid substance to the medical tools that will be inserted into the private part during this process, then the fast will not be nullified. This is because one part of the apparatus enters and one part does not; it does not enter completely. Therefore, the fast will not break due to this. But, if by mistake, it completely enters the private part, the fast will break. Likewise, if the doctor applies any medicine or liquid substance to the tools and inserts it, the fast will be nullified.

It is cited in al-Durr al-Mukhtār:

أَدْخَلَ عُودًاوَنَحْوَهُ فِي مَقْعَدَتِهِ وَطَرَفُهُ خَارِجٌ وَإِنْ غَيَّبَهُ فَسَدَ

If someone inserts a rod or anything of the sort into the back passage and one end of it does not enter, the fast will not break. If it enters completely such that the other end is no longer visible, then the fast will break.

It is also mentioned in al-Durr al-Mukhtār:

أَوْ أَدْخَلَ أُصْبُعَهُ الْيَابِسَةَ فِيهِ أَيْ دُبُرِهِ أَوْ فَرْجِهَا وَلَوْ مُبْتَلَّةً فَسَدَ

The insertion of a dry finger into the back passage or into the private part of a woman does not break the fast. If the finger was wet, then it will become invalidated.

It is stated in Bahār-e-Shari’at that when something is placed into the back passage, if the other end has not entered, the fast does not break. But if the object is wet and that moisture enters, then the fast has broken. This ruling also applies to the private part of woman. “Private part” in this chapter refers to the female reproductive organ.
