QUESTION:

What do the scholars and muftis of the mighty Shari’ah say regarding this matter, if an individual kept the fast of Ramadān and he vomited, and thinking that the fast had broke, he ate some food, will Kaffārah [expiation] be necessary upon him or not? Also, will vomiting invalidate the fast?

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

If someone vomited and he thought that his fast had become void, then he intentionally ate, it is obligatory that he make up the fast only i.e. he will keep one fast with the intention of qadā.

It is mentioned in Radd al-Muhtār,

لَوْ ذَرَعَهُ الْقَيْءُ وَظَنَّ أَنَّهُ يُفَطِّرُهُ فَأَفْطَرَ ،فَلَا كَفَّارَةَ عَلَيْهِ لِوُجُودِ شُبْهَةِ الِاشْتِبَاهِ بِالنَّظِيرِ

“If he vomited and he thought that the fast had become void, then he intentionally ate something, there is no Kaffārah [expiation] upon him, only qadā is obligatory because doubt was created in him due to the similarity with the scenario of Istiqā [intentional vomiting].”

If vomit occurred unintentionally then the fast will not break, but if it was intentional and more than a mouthful, then the fast will break if he remembered that he was fasting. But, if it is less than a mouthful, then the fast will not break, even if it was intentional.

It is stated in Bahār-e-Sharī’at that if one intentionally vomits a mouthful and he remembers that he is fasting, then the fast is definitely broken. If he vomited less than a mouthful, the fast will not break. If he vomited unintentionally, then whether it is a full mouth of not, and in any case, if it went back into the throat, or if he pulled it back into the throat, or if it did not go back, or even if he did not pull it back in, and if it is not a mouthful, the fast will not break, even if it went back into the throat or if he pulled it back himself; and if it was a mouthful and even if only the equivalent of a gram (chana) went down the throat, the fast will be nullified, otherwise not.
