QUESTION:

What do the scholars of the Dīn and muftīs of the Sacred Law state regarding the following issue: If a woman’s menstrual cycle is less than ten days but it has completed in lesser days than this, then can such a woman approach her husband without performing Ghusl?

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

If ten days have not passed for such woman, however her routine amount of days have passed and thus her menstrual being complete with her bleeding having stopped, then one cannot have intercourse until one has not bathed i.e. performed Ghusl, or the time of that salāh passing by in full in which her menstrual cycle had completed.

Just as it is stated in Fatāwā Hindiyyah[1]

“وَإِذَا انْقَطَعَ دَمُ الْحَيْضِ لِأَقَلَّ مِنْ عَشَرَةِ أَيَّامٍ لَمْ يَجُزْ وَطْؤُهَا حَتَّى تَغْتَسِلَ أَوْ يَمْضِيَ عَلَيْهَا آخِرُ وَقْتِ الصَّلَاةِ الَّذِي يَسَعُ الِاغْتِسَالَ وَالتَّحْرِيمَةَ”

“If she became pure in less than ten days, then until such time that she does not perform Ghusl or the time of that salāh in which she became cleansed from menstruation does not pass, intercourse with her is impermissible. If the remaining time (in which she became cleansed) was not enough time in which she could perform Ghusl, have a change of clothes and perform the initial Takbīr[2] of salāh, then it is permissible to have intercourse with her when the salāh time has passed or after she performs Ghusl. (With the exception of either of these, intercourse is not permitted.)”
