QUESTION:

What do the scholars of the Din and muftis of the Sacred Law state regarding the following issue: there are some outstanding fasts from the previous Ramadan due upon me because I was pregnant. There were 20 fasts outstanding, of which I kept 3 and there are now 17 left. Can I pay the fidyah for these missed fasts because the next Ramadan is about to commence and I have not yet managed to make up those 17 previously missed fasts.

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

You will need to do qada (make-up) of those 17 missed fasts after this coming Ramadan and it is not permissible to pay the fidyah to recompense for those missed fasts due to pregnancy. This is because the ruling of fidyah is for old age, and not for the one who is pregnant. It is necessary for the one who was pregnant to do qada of their missed fasts and if whilst making up these fasts the Ramadan of the following year started then she should continue making up her missed fasts after having performed the obligatory fasts of the current Ramadan. And after this month of Ramadan has ended, she can continue making up the fasts of the previous Ramadan.

Just as it is mentioned in the reliable Hanafi book al-Durr al-Mukhtar that:

وَلَوْ جَاءَ رَمَضَانُ الثَّانِي قُدِّمَ الْأَدَاءُ عَلَى الْقَضَاءِ وَلَا فِدْيَةَ

“If the following Ramadan has commenced then give priority to the fasts which are due upon you now over those that you have previously missed and there is no fidyah for the missed fasts.”
