QUESTION:
What do the scholars of the Dīn and muftīs of the Sacred Law state regarding the following issue: I married a new Muslim, but he divorced me due to certain reasons. I have two children aged 8 and 12, am I allowed to get married a second time or do I have to wait until they become mature?

ANSWER:
بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب
If your new Muslim husband has actually given you a divorce, then after the stipulated waiting period established by shariah, you are allowed to get married a second time. It is not necessary for you to wait for your children to reach maturity. Allah to whom is all Purity and who is the Exalted, has addressed the guardians of the women in the Noble Qur’an.
وَ اِذَا طَلَّقْتُمُ النِّسَآءَ فَبَلَغْنَ اَجَلَہُنَّ فَلَا تَعْضُلُوۡہُنَّ اَنۡ یَّنۡکِحْنَ اَزْوٰجَہُنَّ
{And when you have divorced women and they complete their waiting period – then O Guardians of such women, Do not prevent them from marrying their husbands}
[Surah Al-Baqarah, Verse 232]
It is understood from this blessed verse that after being given a divorce, the waiting period is necessary upon the woman. Thereafter she is permitted to marry whomever she likes. In fact, if the parents or any other guardian prevents her from getting married (again), then the Qur’an has prohibited them (the guardians) from doing that.
