QUESTION:

What do the scholars of the Din and muftis of the Sacred Law state regarding the following issue: Zaid missed some Fasts during the month of Ramadan, for which he was compensating (doing qada). One day, his friend invited him for some lunch, if he broke the fast which he was compensating from Ramadan, does he have to give expiation (a kaffarah)?

Questioner: Yusuf from India

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

It is not necessary to give kaffarah for invalidating any fast except the fast which was broken in Ramadan, even if he invalidated the fast kept to make up the missed fast of Ramadan. However, making up for the fast is necessary that means one fast will have to be kept as is mentioned in Dur e Mukhtar ma’a Rad ul Muhtar:

“أَفْسَدَ غَيْرَ صَوْمِ رَمَضَانَ أَدَاءً) وَقَيَّدَ بِهِ لِإِفَادَةِ نَفْيِ الْكَفَّارَةِ بِإِفْسَادِ قَضَاءِ رَمَضَانَ لَا لِنَفْيِ الْقَضَاءِ أَيْضًا بِإِفْسَادِهِ)”

Breaking a fast other than those of the adā of [the current] Ramadan makes qada wājib. By  the condition of current, one comes to know that even by breaking a qada fast of Ramadan, kaffārah will not be wājib, but this does not mean that there is negation of qadā, meaning one will still have to keep the qadā fast to make up for the broken one.

[Dur e Mukhtar ma’a Rad ul Muhtar, Book of Fasting, vol.3]

It is mentioned in Bahare Shari’at:

A person broke a fast outside of Ramadan even if it was a fast kept to make up a missed fast in Ramadan, in all of the aforementioned cases, qada is only necessary, not kaffarah.
