QUESTION:

What do the scholars and muftis of the noble Shari’ah say regarding the following matter; is it permissible for a man to have sexual intercourse with his wife in the bathroom? Is it permissible for both of them to bathe together and touch each other’s private parts?

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

It is permissible for a man to have sexual intercourse with his wife in the bathroom. It is also permissible for them to bathe together, even if there is no veil between them. There is no reprehension of any sort in doing so. It is also permissible for them to touch each other’s private parts.

Husband and wife bathing together is proven from the hadith as well. It is recorded in Sahih Muslim:

عَنْ عَائِشَةَ، قَالَتْ: ” كُنْتُ أَغْتَسِلُ أَنَا وَرَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِنْ إِنَاءٍ بَيْنِي وَبَيْنَهُ وَاحِدٍ، فَيُبَادِرُنِي حَتَّى أَقُولَ: دَعْ لِي، دَعْ لِي

Translation: “’A’isha (may Allah be pleased with her) reported: I and the Messenger of Allah ﷺ took a bath from one vessel which was placed between me and him and he would get ahead of me, so that I would say: Spare (some water for) me, spare (some water for) me.” [Sahih Muslim, hadith no. 321]

It was narrated that ‘Aishah (may Allah be pleased with her) said: “I used to perform ghusl – the Messenger of Allah ﷺ and I – from one vessel. He ﷺ would compete with me and I would with him until he ﷺ would say: ‘Leave me some’ and I would say: ‘Leave me some.'” [Sunan al-Nasa’i, 1/47]

However, there used to be a veil between them whilst bathing. Mulla ‘Ali al-Qari (may Allah have mercy upon him) states:

وَيَحْتَمِلُ الْمَعِيَّةَ، وَعَلَى تَقْدِيرِهَا يَحْتَمِلُ التَّسَتُّرَ كَمَا هُوَ الظَّاهِرُ مِنْ جَمَالِ حَالِهِمَا وَكَمَالِ حَيَائِهِمَا

Translation: “Bathing together is likely but with the discretion that there was possibly a veil between them, as it is evident from the beauty of their states and the perfection of their modesty.”

Sayyidah ‘A’isha (may Allah be pleased with her) states:

مَا رَأَيْتُ مِنْهُ وَلَا رَأَى مِنِّي يَعْنِي الْفَرْجَ

Translation: “Neither of us saw each other’s private parts.” [Mirqat al-Mafatih, vol. 7, pg. 831]
