QUESTION:

What do the scholars of the Din and muftis of the Sacred Law state regarding the following issue; what is the ruling on Cannabis, is eating it allowed or not allowed? The doctor has diagnosed my mother with cancer and some relatives have told my mother that for its cure, she should use one drop of oil made from cannabis, which is beneficial for this. Can my mother use its oil, drop wise daily? This amount of oil does not cause any intoxication.

ANSWER:

الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

Taking that much cannabis that intoxicates and blurs the intellect, is not allowed.

As is in Dur al Mukhtar;

 وَيَحْرُمُ أَكْلُ الْبَنْجِ وَالْحَشِيشَةِ

Translation: ‘Eating cannabis and opium is Haram.’

However for treatment, using a small amount that does not cause intoxication is allowed. Therefore for your mother’s treatment, using cannabis oil drop-wise daily is allowed, because it is a small amount that does not intoxicate. As Allama Ibn Abideen Shaami (علیہ الرحمۃ) writes in their book Dur al Mukhtar, in the commentary to the above text;

“الصَّوَابُ أَنَّ مُرَادَ صَاحِبِ الْهِدَايَةِ وَغَيْرِهِ إبَاحَةُ قَلِيلِهِ لِلتَّدَاوِي وَنَحْوِهِ وَمَنْ صَرَّحَ بِحُرْمَتِهِ أَرَادَ بِهِ الْقَدْرَ الْمُسْكِرَ مِنْهُ، يَدُلُّ عَلَيْهِ مَا فِي غَايَةِ الْبَيَانِ عَنْ شَرْحِ شَيْخِ الْإِسْلَامِ أَكْلُ قَلِيلِ السَّقَمُونْيَا وَالْبَنْجِ مُبَاحٌ لِلتَّدَاوِي، مَا زَادَ عَلَى ذَلِكَ إذَا كَانَ يَقْتُلُ أَوْ يُذْهِبُ الْعَقْلَ حَرَامٌ”

The correctness of this issue is, that the author of Hidayah and other scholars have permitted the use of these substances in small amounts, for treatment. Those scholars that have declared these substances as haram, are for those amounts that intoxicate. That evidence which proves this, is in the commentary of Shaykh ul Islam, Ghaya tul Bayan; ‘little amount of scammonia or cannabis for treatment is allowed, yet that which is more and causes death or destroys the intellect is haram’.

It is in Bahar e Shariat; using that much cannabis and opium that distorts the intellect, is not allowed, like the way addicts use opium and cannabis. And there is no harm if it is used a little, such that the intellect is not distorted. Like in some remedies opium is in small amounts, that per remedy it is such a small amount that the consumer doesn’t even find out that opium was eaten.
