QUESTION:

What do the scholars of the Dīn and muftīs of the Sacred Law state regarding the following issue: If a woman has had a miscarriage, then is the blood which comes out regarded as postnatal bleeding or irregular vaginal bleeding, and what will the ruling be regarding salāh?

الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

If a woman has had a miscarriage and if a particular body part of the child that was miscarried had formed for example, fingers, nails, etc then the blood which comes out after the miscarried child is postnatal bleeding, and salāh is forgiven for as long as this continues to flow. The maximum time limit for this is forty days, and if no body part of the child had formed and the bleeding continued for three days and three nights, and also before this there was a minimum duration of purity of at least fifteen days, then this is the blood of menses, and salāh is also forgiven in this. However, if the bleeding actually stopped three days beforehand, then this is irregular vaginal bleeding; such a woman will have to perform Wudū’ and pray salāh. Just as it is stated in Fatāwā Hindiyyah,

“وَالسَّقْطُ إنْ ظَهَرَ بَعْضُ خَلْقِهِ مِنْ أُصْبُعٍ أَوْ ظُفْرٍ أَوْ شَعْرِ وَلَدٍ فَتَصِيرُ بِهِ نُفَسَاءَ. هَكَذَا فِي التَّبْيِينِ وَإِنْ لَمْ يَظْهَرْ شَيْءٌ مِنْ خَلْقِهِ فَلَا نِفَاسَ لَهَا فَإِنْ أَمْكَنَ جَعْلُ الْمَرْئِيِّ حَيْضًا يُجْعَلُ حَيْضًا وَإِلَّا فَهُوَ اسْتِحَاضَةٌ”

“If any body part of the miscarried child is evident, such as fingers, nails, hair, etc then the woman will be regarded as one whose bleeding is postnatal; it is stated in a like manner in Tabyīn. However, if any body part is not evident, then it is not postnatal bleeding. If it possible to regard it as menses, then it will be regarded as so, otherwise as irregular vaginal bleeding.”

Moreover, it is stated in Bahār-e-Sharī’at that if a female suffered a miscarriage and some limbs of the child have been formed, such as the hands, feet or fingers etc. then this bleeding will be regarded as nifās [postnatal], otherwise if it remained for 3 days and nights and 15 days of purity have passed before this, then it is regarded as menses. However, if it stopped before the end of 3 days or if the full 15 day purification period has not as yet finished, then it is regarded as irregular vaginal bleeding.
