QUESTION:

What do the scholars of the Dīn and muftīs of the Sacred Law state regarding the following issue: What is the share of a widow from her husband’s inheritance after his death? The deceased did not have a child.

Questioner: Brother from UK

ANSWER:

If the issue, as explained by the questioner, were true and assuming that the deceased only had the above-mentioned inheritors, the wife will receive ¼th share from the husband’s wealth after the deduction of the Janazah, the Kaffan, Debts (if he had any unpaid debts) and the Will (if he had one and it had been fulfilled from one-third of the money or property he left behind).

As Allah Almighty has stated in the Holy Qur’an:

And to the women is a fourth of what you leave behind if you do not have any child.
